Not every estate is required to go to through probate. If you have a trust, or if the value of your estate is limited, the estate may avoid the probate process altogether.

In general, an estate must go through probate if the decedent’s property is valued at over $150,000.00. This is true even if there is a will. While a will allows for a person to specify how they want their property distributed on death, a will does not allow you to avoid probate like a trust would.

Probate is the process by which the court oversees the distribution of your property on death. Your property will be distributed according to the state’s intestacy laws if you do not have a will, or according to your will if you do have one.

​If you do not have a will, the court will appoint an administrator to oversee your estate. If there is a will, but it does not name an executor, the court will appoint an “administrator” Most wills, however, will name an executor who is responsible for distributing the estate and managing the estate’s debts.
